By accessing and using Galerly, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

We reserve the right to update these Terms at any time. Your continued use of Galerly after changes constitutes acceptance of the modified terms. We recommend reviewing this page periodically.

Galerly provides cloud-based tools for photographers to create, manage, and share professional photo galleries with clients.

Services include photo storage, gallery creation, client sharing, download management, branding customization, and analytics tools.

To use Galerly, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

You may not share your account with others. Notify us immediately if you suspect unauthorized access to your account.

Your Content: You retain all ownership rights to photographs and content you upload to Galerly. By uploading content, you grant us a limited license to store, display, and process your content solely to provide our services.

Our Platform: All content on this website, including software, design, logos, and text, is owned by Galerly and protected by copyright laws. You may not copy, modify, or distribute any part of our platform without written permission.

Copyright Infringement: If you believe content on Galerly infringes your copyright, reach us through our contact form with detailed information about the alleged infringement.

You agree to use Galerly only for lawful purposes. You may not upload content that is illegal, offensive, defamatory, violates intellectual property rights, or infringes on others' privacy.

Prohibited activities include: attempting to breach security, accessing other users' accounts without permission, distributing malware, spamming, or using automated tools to scrape content.

We reserve the right to remove content or terminate accounts that violate these terms.

Galerly offers four subscription plans: Free, Starter ($9/month or $90/year), Pro ($29/month or $290/year), and Business ($69/month or $690/year). Paid subscriptions require payment in advance and automatically renew unless canceled.

All payments are processed securely through Stripe, in the currency shown at checkout: US dollars, Swiss francs, euros or British pounds, depending on your country. You are responsible for any applicable taxes for your jurisdiction. By subscribing, you accept these billing terms.

Upgrades: Plan upgrades and monthly-to-annual switches take effect immediately. You are charged the full price of the new plan, minus a credit for the unused portion of your current subscription. The credit is calculated as: (current plan price / total days in period) x remaining unused days.

Downgrades: Plan downgrades and annual-to-monthly switches take effect at the end of your current billing period only. You retain full access to your current plan until then.

No Refunds: All payments are final. No refunds or credits are provided under any circumstances, including for downgrades, cancellations, or unused portions of a billing period after a downgrade. Swiss consumer protection laws apply.

Cancellation: You may cancel your subscription at any time from your Billing page. Cancellation takes effect at the end of your current billing period. No refund is provided for the remaining period.

Client Payment Fees: On the Free plan, Galerly charges a platform fee of 15% on client payments collected through the Stripe account connected to your Galerly account. This applies to every payment method offered through Stripe, such as card or PayPal, and to payments for invoices, booking deposits and store purchases.

The 15% fee is calculated on the amount payable after any discount and before taxes and shipping charges. No Galerly platform fee is charged on payments you collect outside Stripe, such as a bank transfer to your own bank account. Paid Galerly plans do not incur this platform fee.

You remain responsible for all Galerly platform fees arising from client payments made through your account. If a platform fee is not deducted automatically at the time of payment, the corresponding amount remains payable by you to Galerly. Deleting your Galerly account does not discharge any outstanding platform fees incurred before deletion.

Outstanding Fees Following Account Deletion: Deletion of an account does not release the account holder from any payment obligation that accrued before deletion. Any fees that remain due to Galerly remain payable notwithstanding the deletion of the account.

Where fees remain outstanding following account deletion, Galerly may refuse to create a new account using the same email address until the outstanding fees have been paid or the matter has otherwise been resolved. Galerly may retain limited information for these purposes in accordance with its Privacy Policy.

Any refusal to create a new account under this provision is without prejudice to the account holder's right to contact Galerly to dispute the outstanding fees or request a review of the relevant account status.

Canceled Subscriptions: Cancelling a paid subscription does not immediately delete your account or its data. Your access remains available until the end of the applicable billing period, after which your account continues on the Free plan. Account deletion is a separate process and takes effect 30 days after you request deletion of your account, subject to the limited retention described in our Privacy Policy and any retention required by law.

Manual Deletions: Content that you manually delete, including photos and galleries, is removed from Galerly's active systems in accordance with our applicable deletion procedures, subject to any retention that is required by law or necessary for the establishment, exercise or defence of legal claims.

Account Deletion: If you request deletion of your account, the account is scheduled for deletion 30 days after your request. You may cancel the deletion request during this period. Following deletion, Galerly will remove your account data and content in accordance with its applicable retention procedures. In limited circumstances, Galerly may retain a restricted amount of information where this is necessary to comply with a legal obligation or to establish, exercise or defend legal claims, including the recovery of outstanding fees.

We may suspend or terminate accounts that violate these Terms or Swiss law.

You are responsible for backing up your content. While we implement industry-standard security measures, we cannot guarantee absolute protection against data loss.

We are not liable for any loss or corruption of your data. See our Privacy Policy for details on how we handle your information.

GALERLY IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS.

Our total liability is limited to the amount you paid for the service in the past 12 months.

Galerly integrates with third-party services (payment processors, hosting providers). We are not responsible for the actions or policies of these third parties.

Links to external websites do not imply endorsement. You access third-party sites at your own risk.

These Terms are governed by and construed in accordance with Swiss law. Any disputes arising from these Terms or your use of Galerly shall be subject to the exclusive jurisdiction of the courts of Switzerland.

Swiss consumer protection laws apply to all users. EU/EEA users retain their consumer rights under applicable EU regulations.

We may modify these Terms at any time. Material changes will be communicated via email. Continued use after changes constitutes acceptance.
